This website is published and operated by Fong Chow International (HK) Co., Ltd., a company incorporated in the Hong Kong Special Administrative Region, with a North American office in Irvine, California. In these terms, “Fong Chow”, “we”, “us” and “our” mean that company and its affiliates.

1.1 The entity you contract with

Depending on the market served, the contracting entity for an order may be the Hong Kong company or its United States affiliate. The entity is named on every quotation, order acknowledgement and invoice, and that document prevails over this page.

By accessing this site, downloading material from it, or sending us an inquiry or a request for quotation, you accept these terms on your own behalf and on behalf of any organization you represent. If you do not accept them, please do not use the site.

2.1 Updates to these terms

We may amend these terms as our products, markets or legal obligations change. The version in force is the one published here on the date of your use, and the “last updated” date above records when it changed. Where a change materially affects an open order, we will notify the account contact directly.

You may view, download and print material from this site in order to evaluate, specify, purchase, operate or service our equipment. All other use requires our prior written consent.

3.1 What you must not do

• No redistribution. Do not copy, republish, resell or redistribute site content except in the course of selling or servicing our equipment.
• No systematic extraction. Do not scrape, mirror, frame, index for resale, or systematically extract content, images, specifications or documents.
• No misrepresentation. Do not misstate your identity, your organization, or your authority to place an order, and do not present yourself as an authorized distributor unless appointed by us in writing.
• No interference. Do not interfere with the operation or security of the site, introduce malicious code, or attempt to access non-public areas or accounts.

We may withdraw access to the site or to any account where these restrictions are breached.

Specifications, capacities, performance figures, dimensions, weights and images on this site are provided for general guidance and are subject to change without notice as products are improved.

4.1 Performance figures

Performance is stated at the test conditions shown. Actual results vary with ambient temperature and humidity, airflow restriction, filter loading, power supply and duty cycle. Nothing on this site is a guarantee of performance on a particular site.

4.2 Market variations

Model ranges, designations, voltages, plug types, refrigerants and certifications differ by market. A model shown here may not be available, approved or supported in your territory, and availability is not guaranteed until confirmed in an order acknowledgement.

4.3 Imagery

Photography and drawings are illustrative. Finishes, fittings, controls and supplied accessories vary by production batch and market.

5.1 Nothing here is an offer to sell

Prices, lead times and stock indications on this site or given verbally are indicative and non-binding. A quotation becomes binding only when issued in writing, and only for the validity period stated on its face.

5.2 Formation of contract

A contract is formed only when we issue a written order acknowledgement. Your purchase order is an offer to buy on our terms; our acknowledgement is the acceptance, and any conflicting terms in your purchase order or portal have no effect unless we have accepted them in writing.

5.3 Terms of Sale prevail

Every sale is governed by our Terms of Sale, supplied with each quotation. Those terms cover price basis and Incoterms, payment and credit, packing and marking, delivery, title and risk, inspection and acceptance, warranty, returns, cancellation and force majeure. Where they conflict with this page, the Terms of Sale prevail for that sale.

6.1 Site content

The site and its content — text, layout, photography, drawings, technical documentation and manuals — are owned by us or our licensors and protected by copyright and other laws. No license is granted except as expressly stated in section 3.

6.2 Marks

The Fong Chow name, logotype and product and series names are our trade marks. You may use them only to identify genuine equipment you are authorized to sell or service, unaltered and in the form supplied in our brand assets. Use in your own logo, domain name, app name or advertising identity requires our written consent.

6.3 Customer programs

Where we develop tooling, molds, artwork, packaging or private-label designs for a customer, ownership and permitted use are governed by the written agreement for that program, not by this page.

Links to third-party sites — certification bodies, freight partners, distributor sites — are provided for convenience. We do not control those sites, do not endorse their content, and accept no responsibility for them or for their handling of your data.

8.1 The site

The site and its content are provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, as to accuracy, completeness or fitness for a particular purpose, and we do not warrant that the site will be uninterrupted or error-free.

8.2 Product warranty

Product warranties are given only in our written warranty statement supplied with the goods. No statement, figure or document on this site extends, varies or replaces that warranty.

8.3 Application guidance

Guidance on sizing, air changes, containment or drying strategy is general information, not engineering advice for a specific site. Equipment must be selected, installed, operated and maintained in accordance with the manual and applicable codes; selection and installation remain the responsibility of the specifier, contractor or engineer of record.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, goodwill, data or anticipated savings, arising from your use of this site.

Our aggregate liability arising out of or in connection with the site is limited to USD 100. Liability arising from the supply of goods is governed by the Terms of Sale for that sale. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be limited.

You agree to indemnify us against claims, losses and reasonable costs arising from your misuse of this site, your breach of these terms, or your unauthorized use of our marks, images or documentation.

Our goods, software and technical data may be subject to the export control, customs and sanctions laws of Hong Kong, the People's Republic of China, the United States and other jurisdictions.

• You agree not to export, re-export, transship or divert our goods in breach of those laws, and to pass this obligation to your own customers.
• You agree not to supply our goods to any restricted party or embargoed destination, or for any prohibited end use.
• All orders are accepted subject to restricted-party screening and to our receipt of any license or authorization required. We may suspend or cancel supply where a transaction cannot be cleared.

Personal data submitted through this site is handled in accordance with our Privacy & Cookie Policy, which forms part of these terms.

We may change, suspend or withdraw all or part of the site, and may suspend or terminate access for any user who breaches these terms, without notice and without liability.

These terms of use, and any dispute arising from them or from your use of the site, are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction.

Where the contracting entity for a sale is our United States affiliate, the governing law and dispute-resolution provisions of the applicable Terms of Sale apply to that sale.

• Severability. If any provision is held unenforceable, the remaining provisions continue in force.
• No waiver. A delay in enforcing any provision is not a waiver of it.
• Assignment. You may not assign your rights under these terms without our written consent; we may assign ours to an affiliate or successor.
• Entire terms. These terms, with our Privacy & Cookie Policy and Legal Notices, are the entire terms governing your use of this site.
• Language. Where a translated version is provided for convenience, the English version prevails in the event of conflict.
